These Terms and Conditions ("Terms") govern your use of the website www.hydrowarehouse.co.nz (the "Website") and the purchase of products from Hydro Warehouse Limited ("we", "us", "our"), an e-commerce and physical store operating in New Zealand selling retail hydroponics equipment, garden supplies, and related products.

  • We are a New Zealand-based business. These Terms are governed by and construed in accordance with the laws of New Zealand.
  • All prices are in New Zealand Dollars (NZD) and include GST unless otherwise stated.
  • We reserve the right to update these Terms at any time. Continued use of the Website or purchases after changes constitutes acceptance of the updated Terms.

2. Products and Intended Use

Our products are sold for legitimate horticultural, gardening, hydroponic growing (including indoor and outdoor plant cultivation for vegetables, herbs, flowers, and other legal plants), and general retail garden supply purposes.

By placing an order and completing a purchase from this store, you confirm and warrant that:

  • All products will be used solely for lawful purposes in compliance with New Zealand law.
  • You will not use the products for the cultivation, production, or manufacture of any controlled drugs or substances in breach of the Misuse of Drugs Act 1975 or any other applicable legislation.
  • You are not purchasing with the intent to supply equipment for illegal activities.

We do not provide advice, instructions, or guarantees regarding the use of products for any specific plant or outcome beyond general horticultural information. We expressly disclaim any responsibility for misuse of products.

3. Orders and Acceptance

  • All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including suspected fraudulent activity or non-compliance with these Terms.
  • Product descriptions and images are for illustrative purposes. While we aim for accuracy, minor variations may occur.

4. Pricing, Payment, and Delivery

  • Prices are subject to change without notice. The price at the time of order confirmation applies.
  • Payment must be made in full at the time of ordering via the approved methods on the Website.
  • Delivery times are estimates only. We are not liable for delays caused by third-party carriers or events beyond our control.
  • Risk in the goods passes to you upon delivery. Title passes upon full payment.

5. Consumer Rights – Consumer Guarantees Act 1993 (CGA)

Where the CGA applies (purchases by consumers for personal, domestic, or household use), our goods come with guarantees that cannot be excluded.

  • Goods must be of acceptable quality (safe, durable, free from defects, and fit for common purposes).
  • Goods must be fit for any particular purpose made known to us.
  • Goods must match their description.

If goods fail these guarantees, you may have rights to a repair, replacement, or refund. These rights are in addition to any manufacturer warranty.

Business purchases or goods bought for business purposes may have limited or excluded CGA rights to the extent permitted by law.

6. Returns and Refunds

  • Returns are accepted in accordance with the CGA and our returns policy (detailed on the Website).
  • We do not accept returns for change of mind unless required by law. Custom or personalised items are generally non-returnable.
  • Refunds (where approved) will be processed to the original payment method, minus any non-refundable fees where permitted.

We comply with the Fair Trading Act 1986. We will not engage in misleading or deceptive conduct, make unsubstantiated claims, or use unfair trading practices.
